The Federal Constitutional Court (Bundesverfassungsgericht, FCC or Court) declared, for the first time, on 19 November 2021 that there is a right to school education under the German Basic Law (Grundgesetz, GG). 1 This decision is ground-breaking since the wording of the Basic Law – in contrast to most con- stitutions of the States (Bundesländer) 2 – does not provide for such a right. Ac- cordingly, it had been disputed whether such a right exists on a (federal) con- stitutional level. 3 Importantly, the Court referred extensively to international human rights law regarding the right to education to support its decision. The paper will focus on the right to school education developed by the FCC in this decision and its interaction with international law.
