Während das Böse in der Philosophie ein klassisches Thema ist, gilt es in der Rechtswissenschaft als Unthema, weil die Rede vom Bösen mystifiziert, personalisiert, naturalisiert, dämonisiert und moralisiert. Der Autor macht geltend, dass dieser unterschiedliche Umgang mit dem Phänomen des Bösen der Verständigung der Disziplinen im Weg steht. Der Kern des Buchs bildet die These, dass das Recht für die Frage des Bösen fruchtbar ist, weil das geltende Recht – verstanden als soziale Praxis – eine implizite Konzeption der bösen Tat enthält. Diese Konzeption wird explizit gemacht und so für die interdisziplinäre Kritik geöffnet.
While evil is a classic topic in philosophy, it is considered a non-topic in law because talking about evil mystifies, personalises, naturalises, demonises and moralises. The author argues that this different approach to the phenomenon of evil prevents dialogue between the disciplines. At the core of the book is the thesis that the law is fruitful for the question of evil because the current law – understood as social practice – contains a conception of the evil act. This conception is made explicit and thus opened up to interdisciplinary debate. The book will also be available in open access upon publication.
