- The tribunals, which have compulsory jurisdiction under section 2 of Part XV of the Law of the Sea Convention ("Convention"), do not enjoy general jurisdiction over disputes about international law. Their jurisdiction is limited, under Article 288, paragraph 1, to disputes "concerning the interpretation or application" of the Convention. However, tribunals having compulsory jurisdiction under the Convention may resort and have resorted to extraneous rules of international law. This contribution analyzes first how tribunals have used the applicable law clause (Article 293 of the Convention) to apply extraneous rules of international law, and second how tribunals have used extraneous rules to interpret the Convention. It explains that the techniques are different, face different methodological challenges and limitations, and can furnish different results. © 2023 selection and editorial matter, James Kraska and Hee Cheol Yang; individual chapters, the contributors.
