This dissertation is a law and economics analysis of gene patents in the EU and the US to make a comparative study of the similar patent laws with different patenting outcomes for medical biotechnology sector. The research question to be investigated is whether the increased number of patents granted in this area are really encouraging the innovation, as well as whether they are being capable of increasing the social welfare.
