Article 5 determines the grounds for refusing to grant relief to international settlement agreements. Article 5.1(a)-(e) refer to the capacity of the parties, as well as several circumstances related to the settlement, its content and terms. Article 5.1(e)-(f) concerns the mediator's conduct. The objective of these grounds is to guarantee due process for the parties in the mediation. It was repeatedly debated in the drafting process whether these grounds were necessary or not. Article 5.2 concerns public policy and the incapacity of being settled.
