  • For decades, both EU and China have noticed the importance of private enforcement in the competition law. EU’s Directive on antitrust damages action entered into force in 2014 and will be implemented by Member States in December this year. In China, the Anti-monopoly law (hereinafter we call it AML) was entered into force in 2008, in which Article 50 confirms the civil liabilities of the violators. In 2012, the Chinese Supreme Court adopted a Judicial Interpretation on AML in order to facilitate the private antitrust action. Both the EU’s Directive and Chinese Judicial Interpretation underlined the significance of compensation in private antitrust action. It should be noticed that the private enforcement in both EU and China are underdevelopment, and my dissertation focused on these common problems; and attempted to find some direction for the future facilitation of the private enforcement.
